Divorce


The technical name of the process of ending a marriage is "dissolution," although it is most commonly referred to as divorce. This process encompasses a wide variety of legal documents, hearings, and orders, including: legal separation; temporary orders for spousal maintenance (alimony), child support, child custody (both legal custody and physical custody), and visitation rights; provisions for each spouse to discover all property owned by and/or possessed by the other, as well as jointly-owned marital estate property; temporary hearings and judgments/orders; final adjudicatory hearings; the court's final judgment (decree); and post-judgment motions and relief.

The spouse who initiates a divorce action is called the "plaintiff;" the other spouse is called the "defendant". Regardless of which spouse starts the proceedings, your attorney is going to need all of the following information for BOTH spouses:

  • Employer name, address, and telephone number
  • Gross and net weekly (or monthly) wages
  • Date of birth
  • Physical descriptions
  • Social Security Number
  • Driver's license number
  • Children's names, dates of birth, and state of health
  • Description and estimated value of all assets
  • Legal descriptions of real property
